What kind of benefits can an accident victim claim?

Nothing can prepare the victim of an accident for the kind of trauma, physical pain and anguish that will last for days and weeks, depending on the nature of the injury. However, compounding the physical pain is financial strain. Victims may need not just emergency medical care, but also require hospitalization, surgeries, specialized care, medications etc. There will be doctor's bills to pay and medication to buy. Even after the person has healed, there may be the need for physical therapy to regain strength and control in vital muscles. After the person returns home, their injuries may be too severe for them to take care of themselves independently. In case of severe injuries like brain injuries where a person may be incapable of feeding, bathing, changing clothes and other routine activities, there may be the need for long term 24-hour care that may last for the rest of the person's life.

In fact, it's very important that future medical expenses be included in an auto accident claim. While you are entitled to compensation for all medical expenses incurred in the past, you may also be eligible for compensation for any medical expenses that may arise in the future. Failure to mention this in a claim can leave a victim with serious financial hardship after months and years, when complications arise, and there is need for further medical treatment.

Victims of an auto accident may also be eligible for compensation for earnings they lost because of the injury. They may also be eligible for compensation for their pain and suffering for their anguish. Victims may also claim damages for loss of consortium. These claims are filed by the spouse of the victim and compensate for loss of companionship, affection and care. Besides, victims may be eligible for compensation for property losses, disability and disfigurement etc. A California auto accident lawyer will be able to help determine your claim amount and recover your rightful compensation.
